Welcome to PhotoFacet! These Terms and Conditions ("Terms") govern your use of our platform and services. By accessing or using PhotoFacet, you agree to comply with these Terms. If you do not agree to these Terms, please refrain from using our services.

1. Acceptance of Terms

The Shutter Bug plan is free for the first month, and since no payment is involved, refunds are not applicable for this tier.

2. Use of Our Services

PhotoFacet provides a platform for photographers to manage and share photos with event attendees. You may use the platform solely for personal and professional purposes related to photography and event management. Unauthorized use, including illegal activities, is prohibited.

3. Account Registration

To access certain features, you may need to create an account with PhotoFacet. You agree to provide accurate and up-to-date information when registering and to keep your account information secure. You are solely responsible for the confidentiality of your account details and activities conducted under your account.

4. Photographer Responsibilities

As a photographer using PhotoFacet, you are solely responsible for the media uploaded, including all photos, videos, and other content shared via the platform. You agree not to upload any content that violates any applicable laws or infringes on the intellectual property or privacy rights of others.

5. Event Attendee Uploads

Attendees may upload their selfies or other media to the platform. By doing so, they grant permission to the photographer to manage, organize, and share their uploaded media within the scope of the event. PhotoFacet does not assume responsibility for any media uploaded by attendees.

6. Data Usage and Privacy

By using PhotoFacet, you agree that we may collect and use your data, including analytics and usage data, to improve our services. We will not use the media uploaded by users for personal purposes. All data collection and usage are in line with our Privacy Policy, which governs how we handle your information.

7. Payment and Billing

Some features of PhotoFacet are offered through paid plans. By subscribing to a paid plan, you agree to pay the fees associated with your chosen package. All payments are processed securely, and you are responsible for ensuring that your payment details are accurate and up to date.

8. Termination of Account

PhotoFacet reserves the right to suspend or terminate your account at any time for violations of these Terms, including but not limited to fraudulent activity, unlawful conduct, or failure to comply with the Terms. Upon termination, you may lose access to your account and any associated content.

9. Media Loss and Liability

While PhotoFacet strives to maintain high standards of data security, we are not responsible for any loss or damage to media files caused by user error, external factors, or third-party integrations. It is your responsibility to maintain backup copies of all uploaded media.

10. Limitation of Liability

PhotoFacet will not be liable for any direct, indirect, incidental, or consequential damages arising from your use of the platform, including but not limited to data loss, media loss, or service interruptions. Our liability is limited to the maximum extent permitted by applicable law.

11. Indemnification

You agree to indemnify and hold PhotoFacet, its affiliates, and its employees harmless from any claims, damages, losses, or expenses arising from your use of the platform, including violations of these Terms or any applicable laws.

12. Modifications to the Terms

PhotoFacet reserves the right to update or modify these Terms at any time. All changes will be posted on this page, and your continued use of the platform constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of the jurisdiction in which PhotoFacet operates. Any disputes will be resolved in the appropriate courts of that jurisdiction.
